The typical method of determining competence and suitability regarding litigation support is to provide the prospective client(s) with limited initial review and response that is considered work product and not subject to discovery. We generally allow two (2) hours for initial review of documents or other information provided by the client. Findings or responses may be verbal or in writing upon request. Fees are typically $125 per hour for all services, including interview, discovery, availability, and testimony. Travel time is billed at $75 per hour.

Ideally, and upon completion of initial review, the client will be provided with a written opinion and statement of estimated time required prior to being retained.

In the event of an extension of credit (ie: services are rendered prior to any payment of fees) then all work product shall remain non-confidential and the property of the appraiser until such time as all consultation, professional service, or litigation support fees have been brought current. Until such time as all fees are paid current, the appraiser shall make all correspondence in writing.

In the event of an advance written engagement and agreed upon retainer, all work product shall be the property of the client and shall be considered extremely confidential by the appraiser/witness/consultant. Unless advised otherwise, all correspondence of findings, conclusions, or opinions shall be in writing. Such correspondence shall be considered work product that is not discoverable until such time as the appraiser has been formally declared an expert witness by the client.
