Realtor Douglas Kues is a California licensed Real Estate Broker and Certified General Appraiser serving the Lake County and Mendocino County market areas for over twenty years.

The opponent has an appraisal of the property prepared by an licensed appraiser, and has retained that appraiser as an expert witness against the interests of your client.  What is your best move?

  • Hire another appraiser and get another appraisal in the hopes it will benefit your client?
  • Depose the expert to see if you can find some character flaw or credibility gap?
  • You know the opposing appraiser, have used them before, and will have difficulty doing either of the above?

How about "none of the above?"

  1. What if you had access to another expert that could effectively review the opposing counsel’s "expert" appraisal and provide you with bullet proof support for either the lack of credibility of the entire report....or an equally supportable alternative value that could remain undiscoverable work product until you and your client can make the correct decision on where to go next.  We DO have the correct option for you!

At BOSS General Appraisal we believe that efficiency and expense management will go much farther in winning your case than waving appraisals back and forth trying to prove that one hired gun is a better marksman than the other.  We believe the right steps, in the right order, should include:

  1. Contact us before deposing the other expert witness appraiser.  Let us summarily review the case and prepare for you the best industry standard specific questions to effectively extract the information you will need to address the credibility and expertise of the witness / appraiser.
  2. Depose the other appraiser / expert witness and obtain a copy of the opinion of value report.
  3.
